Tenant's liability and contents are two different things

Tenant's liability covers damage to the building that you cause: a fire starting in your kitchen, water escaping from your washing machine. The landlord is compensated and the insurer does not turn around and claim it back from you.

Contents covers what belongs to you: furniture, appliances, clothes, computers, a bicycle. It is not covered by tenant's liability, which concerns the building alone.

Many tenants buy the first and skip the second, then discover after a water leak that their own possessions are not indemnified. Estimate the replacement value of what you own room by room; it is almost always higher than the figure that comes to mind.

The lease paperwork that goes with it

The entry inventory — état des lieux d'entrée, plaatsbeschrijving — is drawn up jointly at the start of the lease and registered with it. It is the document against which the exit condition is judged, and it is your protection against being charged for damage that predates you. Refusing to spend an hour on it is the most expensive shortcut in Belgian renting.

The rental guarantee is not insurance and is often confused with it. In Belgium it is normally placed in a blocked account opened in the tenant's name, and the money is released only by joint written agreement between tenant and landlord or by a court decision. Neither party can take it unilaterally.

The lease registration is a landlord obligation for residential leases and matters to the tenant, since an unregistered lease weakens the landlord's position in a dispute. Ask whether it has been done.

Finally, most Belgian leases require an insurance certificate before handover and, in many cases, proof of renewal each year. Set a reminder, because a lapsed policy is a breach of the lease as well as an uninsured risk.

Is a tenant obliged to be insured in Belgium?

What is a recourse waiver in a lease?

A clause by which the landlord, and the landlord's insurer, give up the right to claim compensation from the tenant for defined losses. Is the rental guarantee the same thing as insurance?

No. The rental guarantee is a sum placed in a blocked account in the tenant's name, released only by joint agreement or a court decision at the end of the lease. It secures the tenant's obligations; it does not indemnify a fire or a water leak. Both are normally required.

Does the landlord's policy cover my belongings?

No. The landlord's insurance covers the building, not your possessions. Contents must be insured by you, on the basis of the replacement value of what you own. Where you share the property, check whether each occupant needs their own policy or whether one covers the household.
